How much does a workplace investigation cost?

The cost of a Workplace Investigation through our agency varies, depending on the complexity of the issues. Do I need a lawyer to represent me at fair work?

You do not need a lawyer to represent you at the Fair Work Commission, you can represent yourself. However, depending on the complexity of the case, it might be worth having a representative who possesses Industrial Relations knowledge. In this case, we are Industrial Relations specialists who can represent you, more cost effectively than legal representation, which is not required at this level.

What do I do with a fair work claim?

This process depends on whether you are submitting or responding to a Fair Work Claim. In either case, you need strong documentation and understanding of the nature of the claim. What is the process of Dispute Resolution?

The dispute resolution process refers to actions taken to bring disputes to an end (resolution). How this occurs needs to be based on the issue itself. There are specific processes that are engaged to bring a dispute to resolution, which can include individual meetings, joint meetings, negotiation, mediation, investigation, interest-based bargaining and more. Which process is used will depend on the type of dispute engaged in.

What are the steps of a workplace investigation?

This depends greatly on the complexity of the situation. Generally a HR professional will review the situation and design a Workplace Investigation Plan. This may involve a number of steps including interviewing the claimant or reporter, and creating a Summary of Allegations. Interviews will follow with respondents and any witnesses. A Workplace Investigation is a fact finding mission and will culminate with a report and findings on whether the allegations are substantiated or not substantiated on the Balance of Probabilities.
